 Despite the broad measures taken to curb smoking cessation as yet much of the cast at this addiction. This is no different, and also representing employees and provides for many of the big problem, because the employer can not prohibit employee smoking in the workplace. Smokers and smoking in the workplace is a big problem for any company because the addiction affects the lower labor productivity, a fire safety hazard, affects more sickness absence. Also an important problem is the fact that under Article. 3, paragraph. 1 of the Act of 9 November 1995 on health protection against the consequences of tobacco use and tobacco products (OJ No 10, pos. 55, as amended. D. 1996) Non-smoker workers have the right to life that smoke-free environment tobacco. This provision was extended in the Articles. 5, paragraph. 1 pt. 3 of that Act which contains a mandatory ban on smoking tobacco out of doors and appropriately adapted dissociated indoor workplaces. What is important for banning smoking in work outside the designated premises in the workplace is responsible owner or user of an object (the employer) - Art. 5, paragraph. 1a of the Act. Failure to comply with this prohibition by the employer he was threatened with a fine. Cubic roasting was thus determined that the smoking room should be at least 0.1 m2 of floor space for each employee using the largest change in this room, but on the surface of the individual rooms for smoking areas should not be less than 4 m2.
